Q2: What is the Incoterms rule that is most importer-friendly? Least importer-friendly? Justify your answer.

Q4: The Delivered Incoterms rules (DAT, DAP, and DDP) do not include insurance. Why not?

NOTE:This is not as much of a discussion question, it is more like a quiz type question, testing your knowledge of the CISG topic. You should still review other students’ responses and ask questions where appropriate.

Some thoughts on this question:
Although a seller may obtain insurance for shipments under these terms (you may have seen this in your own experience), it is not required. The seller may purchase insurance to protect themselves, but it is not required.

Q: What do the [Incoterms] rules say about cargo insurance?

In general, the rules are silent on the matter of insurance – the buyer and the seller each decide whether they wish to insure the cargo for that part of the journey for which they bear the risk of loss or damage.

However the CIF (Links to an external site.) Links to an external site.and CIP (Links to an external site.)Links to an external site.rules have specific provisions.

In both cases, the seller is required to buy cargo insurance for the portion of the journey where the seller is “off risk”, once the goods have been delivered (Links to an external site.)Links to an external site.to the carrier.

This insurance is for the benefit of the buyer, who must claim from the insurer if necessary.
