On the Written Assignment, Client Opinion Letter, please skip in the Immunity issue.Generally, the legal fact of immunity is relatively clear cut and, ifthe city had immunity, the lawyer would know this and you would not bewriting to Ms. Dorite. Furthermore, unless Ms. Dorite is an unusuallysophisticated client, you would have to spend a page or so on what legalimmunity actually is, and she still would likely be confused. If I hadto address such a legally complicated issue with a client, I would doit in person so there could be Q and A, and I would never ask myparalegal to communicate with a client about this issue.

In preparation for this week's written assignment please review thefacts of the interview with Ann C. Dorite and your summary from Module02. Please also review your case briefs for Curatola v. Niles, 154 Ill.2d 201, 608 N.E.2d 882 (1993) and Gutstein v. City of Evanston,402 Ill. App.3d, 929 N.E.2d 680 (App. Ct. 2010) from Module 04. Afterdoing so write the following letters and submit them as one document.

1. Write a transmittal letter in which you ask your client, AnnC. Dortie, to send in a copy of the police report made about theincident. Remember to put your letter on firm letterhead (youcreate it).
2. Write a client opinion letter to your client, Ann C. Dorite,explaining whether she can sue the City of Lyons. The lettershould address two issues, namely, whether the City of Lyons hasimmunity from Ms. Dortie's law suit and whether the City of Lyonsowes Ms. Dorite a legal duty to maintain the streets. Base yourletter on the Curatola and Gutstein cases as applied to the factsof Ms. Dorite's case.
