Case Info:

CrazyLoans2U is a private loan processing company with 200 employees located in Sarasota, Florida. The company conducts reviews of loan requests from companies who need extra capital for their business. It also provides the companies with solutions to improve their performance and how to best obtain and repay their loans.

Nancy Johnson is a 45 year old employee who has been diagnosed with bipolar disease. At first, she did not want to notify her direct manager or the Human Resources department of her condition because she was worried about the stigma associated with mental disorders. She faithfully took her medication, but she was forced to deal with the side effects. For several days in a row, she fell asleep at her desk due to drowsiness. Her direct manager noticed and verbally reprimanded her for it and when she was awake she spent up to 20 minutes at a time in the restroom; another side effect of the medication. When her manager tried to write her up, she officially notified him of her diagnosis and sent a letter to the HR department, but it didn’t include any medical records or letter from her treating physician.The negative mark was kept in her file and included in her permanent file.She also overheard her manager talking to another manager saying that they should just fire her because sick people shouldn’t even be allowed to work with money.

After the conversation with her boss, Nancy avoided taking her medication to so she wouldn’t be fired. During her depression phase, she lost interest in everything and missed several deadlines. In her manic phase, she was disruptive at the office and offered several drastic solutions to the team. So, she again explained to her boss that she had the disease and asked for accommodations for her situation. She asked for a schedule that allowed her to start an hour later than her co-workers, when necessary because she sometimes missed sleep for several days and she asked to be allowed to leave early when in her manic phase. Her boss declined her request for schedule flexibility and wrote her up again.

On April 7, after being off her medication for several weeks, Nancy was feeling horrible. During the monthly meeting she started feeling angry. As she was leaving the meeting, she was stopped by another employee, Hector Rodriguez, who made a comment that she took as an attack. She yelled at Hector and slapped his laptop out of his hands. Hector immediately reported the incident to their manager who again wrote Nancy up and used the incident as an excuse to fire her

Nancy started taking her medication, but has been unsuccessfully looking for work.She sought advice from an attorney to learn her rights and options.As a result, the proper steps were followed and Nancy has filed suit against CrazyLoans2U.
