1. Under the federal Controlled Substances Act (CSA) the possession, cultivation, or distribution is prohibited unless utilized for approved research. Presently, there are nine states where recreational marijuana is legal and twenty-nine states where medical marijuana is legal. This has caused great division among state and federal laws, according to federal law these activities are punishable by criminal penalties, whereas, according to state law the usage of certain marijuana related activities is increasing. Businesses and individuals that participate in these types of activities may not be breaking state law but are held to federal criminal prosecution under federal law standards. According to the Supremacy Clause, any state law that conflicts with federal law are generally obstructed, hence, considered void and without effect.

2. Michigan residents and visitors are protected from exposure to secondhand tobacco smoke in all restaurants, bars and businesses (including hotels and motels), thanks to Public Act 188 of 2009, Michigan's Smoke-Free Air Law.

Clean air is fundamental to good health. The public health and well-being of workers and customers alike is the best reason for state government to ensure smoke-free businesses, including restaurants and bars. Smoke-free air is good for Michigan residents, workers and visitors – and now – Michigan is serving smoke-free air.
