The healthcare field is heavily regulated. Healthcare providers of all sizes find complying with all of these regulations to be both time consuming and expensive. Although the penalties for non-compliance can be incredibly steep, many small practices choose to go forego a formal compliance program and even basic policies and procedures. By foregoing a compliance program, are practitioners risking patient care and patient privacy? What other potential issues may arise for both these practitioners and their patients?
Question #2:
The Anti-Kickback Statute and the Stark Laws focus on improper relationships between healthcare providers and self-referral. The Physician Payment Sunshine Act is also now bringing transparency to relationships between pharmaceutical/biotechnology companies and physicians and teaching hospitals. Should physicians and hospitals be required to publicly declare their financial relationships with other providers, pharmaceutical/biotechnology companies, family members and self-referral? Even with full transparency, can practitioners truly ensure that gifts and financial arrangements do not influence their decisions regarding referrals, using and prescribing those goods or services?
Please see grading rubric below. This assignment should be at least 4-5 paragraphs each and very thorough. Make sure you integrate real-life applications to support key points.
